DMCA Copyright Policy – SwipeSaga

At SwipeSaga, we fully respect and protect the intellectual property rights of developers, publishers, artists, writers, musicians, and all content creators involved in the mobile gaming industry. As a platform that may host, review, distribute, showcase, or promote mobile game-related content, we strictly adhere to the guidelines and procedures outlined in the United States Digital Millennium Copyright Act (DMCA). This policy provides clear instructions for reporting copyright infringement, filing counter-notifications, and understanding the legal responsibilities associated with mobile game content.

Mobile gaming has evolved into one of the most widely consumed forms of digital entertainment worldwide. With millions of applications, diverse user bases, and rich multimedia integration, mobile games often contain complex combinations of artistic, literary, and technological content. These elements are protected by copyright law, and unauthorized usage of any such component may constitute infringement.

What Is Protected in Mobile Game Content

Copyright applies to a broad range of creative works found in mobile games, including:

  • Source code, programming scripts, and software architecture
  • User interface (UI) elements, HUD layouts, and design structures
  • Visual components: characters, environments, items, sprites, and textures
  • Audio: original soundtracks, background music, dialogue, and sound effects
  • Narrative elements: in-game stories, quests, character development, and world-building
  • Game mechanics unique to the mobile platform
  • Promotional media and digital marketing materials
  • Brand assets: logos, studio names, app previews, and in-game branding
  • Downloadable content (DLC), in-app purchases (IAP)
  • AR features, overlays, and camera-based interactions

Submitting a DMCA Takedown Notice

If you are the legal copyright holder or an authorized agent and believe your mobile game content is being used without permission, submit a DMCA takedown request including:

  • Your full legal name and physical or electronic signature
  • Description of the copyrighted material
  • Specific URL or location of the infringing content
  • Contact information (address, phone, email)
  • A good faith statement regarding the unauthorized use
  • A declaration under penalty of perjury of the accuracy of the notice

Upon receipt of a valid notice, we will investigate, remove or disable access if necessary, and notify the involved parties. The notice content may be shared with the alleged infringer.

Counter-Notification Procedure

If your content was removed due to a DMCA request and you believe it was an error, you may file a counter-notification including:

  • Your full name and contact details
  • Description of the removed material and its original location
  • Good faith statement under penalty of perjury regarding the mistake
  • Consent to jurisdiction and court proceedings
  • Your signature (physical or electronic)

We will forward your counter-notification to the complainant. If they do not pursue legal action within 10–14 business days, content may be reinstated at our discretion.

Repeat Infringer Policy

Users with multiple valid DMCA complaints may be subject to:

  • Account suspension or termination
  • Blocking of content uploads
  • Permanent platform restrictions

All activity is monitored and logged to detect repeated infringement behavior.

Responsibilities of Developers, Publishers, and Content Creators

When uploading content, you must ensure it:

  • Is original or properly licensed
  • Does not include unauthorized assets
  • Is not a pirated or modified app
  • Respects third-party rights (music, code, visuals)
  • Does not violate embargoes or closed tests

Reviewers and commentators must apply fair use principles and provide transformative material.

Fair Use and Transformative Works

We support transformative content such as reviews, parodies, and education, which may qualify as fair use. However, fair use is not a guaranteed defense. Content must be:

  • Transformative in nature
  • Non-commercial or educational

We handle such cases through the standard DMCA process but do not make legal determinations of fair use validity.

Prohibition of DMCA Misuse

Abuse of the DMCA process (fraudulent, retaliatory, or deceptive claims) is prohibited. Consequences include:

  • Account bans
  • Loss of services
  • Legal action or referral
  • Permanent DMCA privilege removal

Our Role in the Mobile Gaming Community

We support a safe and creative mobile gaming ecosystem. Our commitments include:

  • Swift and fair DMCA response
  • Respecting both user and creator rights
  • Transparent takedown and counter-notification process
  • Fair dispute resolution opportunities
  • Educating users on copyright best practices
